DCAP Digital Sdn Bhd (Company No. 202201030127 (1475824-T)) (“DCAP”) values your privacy and we are committed to protect all your Personal Information in accordance with the law including the Personal Data Protection Act 2010.

This Privacy Notice describes our practices in handling Personal Information we collect through your use of or access to the website dcap.my (“Platform”) and all content, products, services and functionality available at or through our mobile application, if any and/or the Platform (collectively, “Services”).

This Privacy Notice explains:

how we use the Personal Information;
disclosure of the Personal Information; and
your rights to access and update your Personal Information.

By using our Services, you agree to the terms of this Privacy Notice and you will be deemed to have consented to the collection, use, and disclosure of your Personal Information in accordance with this Privacy Notice.

PERSONAL INFORMATION WE COLLECT

“Personal Information” means any information relates directly or indirectly to you, including but not limited to your name, bio-data or personal profile, National Registration Identity Card number, passport number, address, telephone number, email address, images, your personal preferences, financial and banking account information and any information which may identify you, as well as any other non-public information about you that is associated with or linked to any of the foregoing data or any other information relevant to your application for the Services arising from your transaction(s) with us.

“Anonymous Information” means data that is not associated with or linked to your Personal Information including, aggregated information, Anonymous Information does not, by itself, permit the identification of individual persons.

In order for us to provide you the Services we may need to and/or may be required to collect, record, hold, use, disclose and store (“process”) Personal Information and Anonymous Information including but not limited to:

Information you provide to us through your relationship with us, including but not limited to, information provided by you when using the Services, when taking part in customer surveys, competitions and promotions.
Information you provided through any other contact with out affiliates which shall include our partners, holding companies, subsidiaries, any associated companies or related companies, including any company as a result of any restructuring, merger, sale or acquisition (“Affiliates”).
Information obtained from analysis of your payment, and/or other transaction/services with us or any of our Affiliates and such data as may be provided by our third-party partners.
Information from third parties including but not limited to, our partners, employers, joint account holders, authorised representatives, industry/financial related associates, government agencies, statutory authorities, law enforcement agencies, retailers, social networks and/or other organisations.
Information from Credit Reporting Agency or Central Bank including but not limited to the Central Credit Reference Information System (“CCRIS”), Experian Information Services (M) Sdn Bhd (“Experian”) and/or CTOS Data System Sdn Bhd (“CTOS”).
Information from such other sources which you have given your consent to disclose information relating to you and/or where not otherwise restricted.
Information collected from you about others where you have provided Personal Information relating to other individuals (such as your family and dependents) to us for the purpose of using the Services, you represent and warrant that you are authorised to provide their Personal Information to us and the Personal Information provided are correct. You also represent and warrant that you have obtained their consent for their Personal Information to be processed and used in the manner as set forth in this Privacy Notice. We have the right to terminate the Services provided if the permission is withdrawn by any of the third parties.

HOW WE USE YOUR PERSONAL INFORMATION

We may use your Personal Information to respond to requests that you make, or to assist us in serving you better, whether or not through technological means, for one or more of the following purposes:

to assess your request and provide the Services;
to verify your financial standing and credit worthiness through credit reference/reporting checks;
to facilitate the creation of Account on our platform;
to provide improved administration of our Services;
to promote our products, services and special offers of third parties whose products and services we think may be of interest to you;
to improve and customize the quality of your experience with our Services;
to update, consolidate, and improve the accuracy of our records;
to send you a welcome email or short message services (SMS) and to verify the ownership of the email address and mobile number when your Account is created;
to respond to your inquiries or other requests;
to send offers and promotional materials related to our Services and for other marketing purposes;
for our day to day operations and administrative purposes including account management, billing and collection, audits, reporting and investigations;
for the purposes of enforcing or defending our legal rights and/or obtaining legal advise including to recover any debt owing to us;
to assist in the prevention, detection or investigation or crime or possible criminal activities or for the administration of justice;
for any other purpose that is required or permitted by any law, regulations, guidelines and/or relevant regulatory authorities;
for security and internal audit purposes;
for such other purposes as may be directed or consented to by you; and
for all other purposes in relation to or incidental to the above.

We may also anonymize or aggregate your Personal Information by excluding information such as your name that make the data personally identifiable to you. This Anonymous Information may be used to personalize the Services, including directing certain advertisements to make them more relevant to you or to analyze request and usage patterns so that we may enhance the content of the Services and improve the Platform navigation or for any related market research or analytic purposes, either internally or through third parties.

DISCLOSE OF THE PERSONAL INFORMATION

Subject to any laws (including regulations, guidelines and/or obligations) applicable to us and our Affiliates by using our Platform and/or Services, you consent to the disclosure of your Personal Information as described below and else where in this Privacy Notice:

We may share your Personal Information to third party service providers (a) to provide you with the Services that we offer you through the Platform (b) to conduct quality assurance testing (c) to facilitate creation of accounts (d) to provide technical support; and/or (e) to provide other services to us. These third party service providers are not authorized to use your Personal Information other than to provide the Services requested by us.
We may share your Personal Information with our Affiliates, in which case we will require our Affiliates to honor this Privacy Notice.
We may share your Personal Information with any persons directed by or consented to by you.
We may share your Personal Information with our professional advisor including but not limited to legal advisors, tax advisors, financial advisors, auditors, insurance brokers etc.
We may use or disclose your Personal Information to any credit reporting agency/credit bureau, bank and/or financial institution.
We may disclose your Personal Information to any bureaus or agencies established or to be established by Bank Negara Malaysia including but not limited to CCRIS.
We may use or disclose your Personal Information to any debt collectors/debt collection agencies, regulatory agencies, or consultant at our absolute discretion deems necessary in terms of any action taken for the purpose of enforcement or any right as stated in our terms and conditions.
We may disclose your Personal Information to any government agencies, statutory authorities and/or law enforcement agencies in accordance with the law of Malaysia.
Regardless of any choices you make regarding your Personal Information, we may disclose your Personal Information if we believe in good faith that such disclose is necessary (a) in connection with any legal investigation (b) to comply with relevant laws or to respond to subpoenas or warrants served on us (c) to protect or defend our rights or property or users of the Services and/or (d) to investigate or assist us in preventing any violation or potential violation of the laws, this Privacy Notice, or our terms and conditions.
We may also be required to transfer your Personal Information outside of Malaysia for the purposes and to such third parties stated in this Privacy Notice.

YOUR RIGHTS TO ACCESS AND CORRECT YOUR PERSONAL INFORMATION

We offer you choices regarding the collection, use, and sharing of your Personal Information. Nevertheless, should you decline to provide any Personal Information that is essential to us to process your application/request, we may not be able to process your application/request or provide you with the Services.

DCAP and our Affiliates may periodically send you free newsletters and emails that promote the use of the Services or offers which we believe may be important and beneficial to you. When you receive the newsletters or promotional communications from us from various channels, including telephone, email, electronic/mobile message, facsimiles or post, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the “unsubscribe” instructions provided in the email you receive.

Despite your indicated email preferences, you may not opt-out of communication related to the terms and conditions of the Services, including any updates to our terms and conditions or Privacy Notice unless you have completed and deactivated the use of the Services.

You may change your Personal Information in our possession or control through your profile within your Account to ensure that such Personal Information held by us is not inaccurate, incomplete, misleading or not up-to-date. To do so, please send us a clear and legible image of your signed request in writing to admin@dcap.my with email subject “Update Personal Information”. We reserve the right to decline requests that jeopardize the security and privacy of the Personal Information of others as well as requests that are impractical or not made in good faith. Additionally, it is important to note that system-recorded Personal Information is not editable. When we delete any information, it will be deleted from the active database, but may remain in our archives. To the extent permitted by law, we may also retain your information for fraud prevention or similar purposes required by laws.

RETENTION AND SECURITY OF YOUR PERSONAL INFORMATION

We place great importance on ensuring the security of your Personal Information and shall endeavour to regularly review and implement up-to-date technical and organisational security measures to safeguard the confidentiality and security of all your Personal Information. This includes contractual agreements with relevant third parties, whereby we shall endeavour to procure them to incorporate our standards as a minimum. Your Personal Information will also be retained in compliance with this Privacy Notice and/or the terms and conditions of your agreements for the duration of your relationship with us, for such period as may be necessary to protect our interests as may be deemed necessary, where otherwise required by the law or relevant regulation. We may require you to enter a password to access your Account information, and you should not disclose this to anyone. Therefore, while we use reasonable efforts to protect your Personal Information, we cannot guarantee its absolute security.

REVISION TO PRIVACY NOTICE

We may review and update this Privacy Notice from time to time to reflect changes in the laws, in our business practices, procedures and structure, and the community’s changing privacy expectations. The latest version of the Privacy Notice will be made available on the Platform.

Where we consider, at our sole discretion, that the revisions made on the Privacy Notice are substantive, notice of such revisions will be provided on the Platform or by such other means of communication deemed suitable by us, for example, by sending you an email to the last email address you provided to us. Please note that you are solely responsible for updating your Personal Information and to provide us with your most current email address. In the event that the last email address that you have provided us is invalid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the email containing such notice will nonetheless constitute effective notice of the revisions made.

If you do not agree to the changes in our use of your Personal Information, you must notify us immediately and deactivate your Account or cease the Services with us. Continued use of our Services, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
